With your estate agent you have the opportunity to visit several properties before finally choosing The real estate agency will accompany you during the sales process, from the "start" phase of initial contact through until the finalization of the purchase at the public notary.
Once the property has been found, you must sign the reservation contract and pay an amount set by the agency. In this contract are mentioned: the names of the seller and the buyer, the agreed selling price and the organisation of dates for the future.
A private sales contract should be signed once the terms of the initial reservation contract have been accepted by both parties. What will be visible in this contract are the identities of the buyer and seller, the details of the contract and the date of final transfer of the property. A 10% deposit payable to the seller is normal at this point.
Following the signing of the title deed at the notary, the details of the new owners are passed to the Javea Land Registry office if the property is located in the municipality or in the respective registry office if the purchase has been made elsewhere.
Referring to the purchase costs: if the purchase is made via a real estate developer, the VAT is 10% (new properties). For resale housing, it is also 10%. In addition the purchasers will have other costs of Notary, Land Registry etc amounting to between 12% and 13% of the purchase price.
When you have made your choice, the use of a Spanish lawyer (bilingual) is highly recommended as they will help you in Spanish acquisition contracts. The agency will also accompany you in these different matters and are on hand to help with any issues that occur both pre and post purchase.
